Terms and Conditions for Panel Membership, Survey Participation, and Use of Services

When used in these Terms, the following terms and expressions shall bear the following meanings.“Active Panellist” refers to a Panel Member who has: (a) participated in a Survey, (b) another Research Programme, or (c) other parts of the Service, at least once in the past twelve (12) months; or (d) updated his or her profile or membership information at least once in the past twelve (12) months.
“Market Research Tracking Service” refers to a Service accepted by a User that may track the User’s online behaviour, such as websites accessed and online campaigns viewed, for market research purposes, including advertising tracking research.
“Applicable Law” refers to applicable national and/or local laws and regulations.
“Client” refers to Our clients to whom We provide services.
“Content” refers to the information on Our Site, a Survey Site, a Panel Site, or a Partner Site.
“Panel” refers to a group of individuals who have agreed to be invited to and participate in market research Surveys, other Research Programmes, or other aspects of the Services for market research purposes.
“Panel Member” refers to a member of a Panel.
“Panel Owner” refers to the owner of a Panel and the Panel Site of which You are a Panel Member.
“Panel Site” refers to a website where individuals may register to become Panel Members.
“Partner” refers to one of Our partners, including Panel Owners and other partners.
“Partner Site” refers to a website operated by one of Our Partners.
“Participant” refers to an individual who is not a Panel Member, but who is directed to a Survey, another Research Programme, or other parts of the Services by one of Our Partners.
“Personal Data” means any information relating to an identified or identifiable natural person (“Data Subject”); an identifiable natural person is one who can be identified or located, directly or indirectly, in particular by reference to an identifier either alone or when combined with other personal or identifying information. Personal Data may include information such as name, national insurance number, date and place of birth, mother’s maiden name, biometric records, photographs, sound or video recordings, and other information linked or linkable to an individual, such as medical, educational, financial, and employment details. (NOTE: Personal Data may also be referred to as Personally Identifiable Information or PII.)
“Research Programme” refers to a research opportunity other than a Survey.
“Restricted Content” refers to confidential and/or proprietary information, materials, products, and Content belonging to Us and/or a Panel Owner, a Survey Owner, a Client, a Partner and/or a licensor.
“Service” refers to the service provided by Us that allows You, as a Panel Member or a Participant, to take part in (a) a Panel or a Survey, (b) another Research Programme, or (c) any other service provided by Us and used by You, such as a Market Research Tracking Service.
“Submissions” refers to all comments, feedback, suggestions, ideas and other information that You submit or that We collect when You participate in a Panel, respond to a Survey or another Research Programme, or use a Service.
“Survey Owner” refers to the owner of a Survey, typically a Client.
“Survey Site” refers to the website where You respond to and complete a Survey.
“Surveys” refers to market research surveys made available by Us to You.
“Third Party Websites” refers to websites maintained and/or operated by third parties.
“User” refers to You as an individual when using the Service.
“User Content” refers to all content, materials, information and comments that You use, upload, post, or submit, or that We collect when You use the Service, including information received through Ad Tracking Services, such as internet usage pattern data.
“You”, “Yourself”, “Your” and “Yours” refer to you as an individual.
“We”, “Us”, “Our” and “Cint” refer to the Swedish company Cint AB, company number 556559-8769.
1. Applicability; Agreement
These Terms and Conditions (hereinafter the “Terms”) apply in addition to any agreement You may have with the Panel Owner of the Panel of which You are a Panel Member, as well as any specific terms that may apply to a Survey, another Research Programme or another Service. These Terms shall not apply to the extent that they conflict with the terms of an agreement between You and a Panel Owner or with specific terms set by a Panel Owner or Client as a condition of Your participation in a Survey or another Research Programme; provided, however, that such other terms must not reduce Our rights or increase Our liability as specified in these Terms.2. Introduction
The purpose of these Terms is to outline the general terms and conditions governing Your use of the Services, including Your participation in Surveys, Panels, or other Research Programmes.We manage the relationship between a Survey Owner and a Panel Owner, acting on behalf of the Panel Owner. We are also the platform provider, offering opportunities for Panel Members to participate in Surveys, other Research Programmes, and to use other Services.
In addition to the above, We may also administer incentives. Details concerning such incentive schemes can be found in these Terms.
3. Panel Membership Eligibility
Panel membership is generally open to individuals who meet the criteria for membership, including (but not limited to) minimum age and geographical requirements. These criteria may vary by Panel and are set by the relevant Panel Owner. By agreeing to become a Panel Member, You consent to receive invitations to participate in Surveys, Research Programmes, or other Services — both from the Panel Owner You applied to and from other Panel Owners. You may unsubscribe from Panel membership at any time; please refer to Section 12 “Opt-Out Policy” below.We only allow one Panel Member per unique e-mail address within each Panel.
4. Panel Registration
To become a Panel Member, You must register on a Panel Site and provide certain information about Yourself. The information You provide must be accurate, truthful, and complete. We reserve the right to limit or deny Your access to the Service or participation in a Survey or Research Programme if You provide information — or We reasonably suspect that You have provided information — that is false, inaccurate, or incomplete.Panel membership is personal and may only be used by the individual who registered for that membership. You are responsible for maintaining the confidentiality of Your user credentials and for all activity (authorised or unauthorised) carried out through Your membership account.
5. Conditions for Participation in a Survey, Other Research Programme or Other Services
When You take part in a Survey, other Research Programme or other Service — or use Our Site, a Survey Site or a Panel Site — You are required to comply with these Terms, as well as any additional terms and conditions applicable to Your participation, including any agreement between You and a Panel Owner or terms applied by a Client or Partner.By participating, You agree to provide information that is accurate, truthful, and complete. If You provide — or We reasonably suspect that You have provided — false, inaccurate or incomplete information, You may be disqualified from that Survey, Programme or Service and may not receive any associated incentives. In such cases, the Panel Owner may terminate Your membership, and You may no longer be eligible to take part in future Surveys or Research Programmes.
You are responsible for all actions and communications made through or from Your account.
6. Use of the Services
Participation in a Survey, other Research Programme or use of other Services is entirely voluntary. The Services are intended for personal, non-commercial use only, and We reserve the right to change, modify, restrict, or block access to all or any part of the Services without prior notice.We may, at any time and at Our sole discretion, decline to provide the Services to any individual.
You acknowledge that You are accessing, using, and/or participating in the Services in the capacity of an independent contractor. No relationship of agency, partnership, joint venture, employment, or franchising is intended to be created — or is created — by these Terms.
7. Unauthorised Use
You agree not to:(a) disrupt, interfere with the security of, or otherwise misuse the Service, or Our Site, a Survey Site, a Panel Site, a Partner Site, or any associated services, system resources, accounts, servers, or networks connected to or accessible via a Survey or affiliated site;
(b) use spiders, robots, or other automated data mining tools to catalogue, download, store, reproduce, or distribute data or content made available in connection with the Service, or otherwise manipulate the outcome of a Survey;
(c) take any action that interferes with Our Site, a Survey Site, a Panel Site, a Partner Site, or any individual’s use thereof, including but not limited to overloading or crashing a website;
(d) send or transmit any viruses, corrupted data, or any other harmful, disruptive, or destructive code, file, or material, including spyware, malware, or trojans;
(e) collect any Personal Data from other Users of the Services;
(f) send unsolicited e-mails, including advertisements or promotional materials for products or services;
(g) open, use, or maintain more than one (1) membership account within a Panel;
(h) use or attempt to use another User’s account without authorisation, or create an account under a false identity;
(i) attempt to gain unauthorised access to Our Site, a Survey, a Survey Site, a Panel Site, a Partner Site, or any part thereof that is restricted from general access;
(j) forge or conceal Your true identity;
(k) frame any part of Our Site, a Survey Site, a Panel Site, or a Partner Site, or display it via another website or medium, or otherwise alter its appearance;
(l) establish links from a website to Our Site, a Survey Site, a Panel Site, a Partner Site, or to any Services, without Our prior written consent;
(m) post or transmit any threatening, libellous, defamatory, obscene, pornographic, lewd, scandalous, or inflammatory material or content;
(n) use any offensive, abusive, or obscene language on Our Site, in a Survey, or on a Survey Site, a Panel Site, or a Partner Site;
(o) engage in any fraudulent activity, including but not limited to rushing through Surveys, taking the same Survey multiple times, providing false information during registration, submitting fabricated Survey responses, redeeming or attempting to redeem incentives fraudulently, tampering with Surveys, or — in relation to the Ad Tracking Service — accessing websites or campaigns solely to misrepresent Your online behaviour;
(p) reverse engineer any aspect of the Service or attempt to disclose source code, or bypass or circumvent any measures used to prevent or restrict access to any webpage, content, or code, except as expressly permitted under Applicable Law;
(q) engage in any unlawful or criminal acts that may be associated with Our Site, a Survey, a Survey Site, a Panel Site, or a Partner Site;
(r) use Restricted Content in breach of these Terms; or
(s) encourage or instruct others — including Panel Members, Participants, or Our employees — to act in violation of these Terms.
8. Restricted Content
Unless otherwise stated, all materials — including, without limitation, concepts, text, designs, graphics, drawings, photographs, video clips, music, sounds, trademarks, service marks, and trade names — used in any Survey, other Research Programme or Service and/or on Our Site, a Survey Site, a Panel Site, or a Partner Site, along with their arrangement and selection, are protected by intellectual property rights. These may include copyrights, trademarks, patents, or rights to apply for such protections globally, and are held or licensed by Us, a Survey Owner, a Panel Owner, a Partner, or other relevant third parties who own or control such Restricted Content.When You use a Service or take part in a Survey, Research Programme or other Service, You may be exposed to Restricted Content. You are not granted any rights to this Restricted Content, and all intellectual property rights are expressly reserved. No licence is granted to You to use, disclose, download, copy, distribute, or reproduce (including posting on any website, social media, or blog) any part of the Restricted Content or its subject matter. Please be aware that legal proceedings may be initiated if any unauthorised use of Restricted Content is traced back to You. You acknowledge and agree that We will fully cooperate with all legitimate third-party disclosure requests (including, but not limited to, the disclosure of Your identity) in connection with allegations of unauthorised use of Restricted Content in breach of these Terms.
You may only use Our Site, a Survey Site, a Panel Site, a Partner Site, or participate in any Survey, Research Programme, or other Service in ways that do not infringe Our, or any third party’s, intellectual property rights.
9. User Content
You are fully responsible for all User Content. Where applicable, You are also responsible for obtaining any required approvals, consents, or authorisations from third parties for both Your and Our use of such content. User Content, including photographs and audio or video recordings, may be regarded as Personal Data. Your User Content may become publicly accessible and shared with third parties — including, but not limited to, Our Clients, the Clients of Our Clients, Survey Owners, Panel Owners, Partners, and third-party service providers. You must ensure that Your User Content does not include any copyrighted or trademarked material owned by others, including audio, video, images, or the likeness of anyone other than Yourself, unless You have obtained all necessary rights and permissions for Your and Our lawful use of such content. You will not receive compensation for the use of Your User Content by Us, Our Partners, or Our Clients.By uploading, posting, submitting, or allowing Us to collect User Content (such permission being deemed granted upon Your acceptance of these Terms and use of the relevant Service), You grant Us a perpetual, irrevocable, unrestricted, transferrable, sub-licensable, worldwide, royalty-free licence to edit, copy, transmit, publish, display, create derivative works from, reproduce, modify, distribute, and otherwise use Your User Content at Our discretion. Unless otherwise explicitly agreed, You will not be entitled to any compensation for Your User Content or Our use of it.
You are solely responsible for ensuring that Your User Content, and Our use of it in accordance with these Terms, does not infringe any third party’s intellectual property rights. We do not, and cannot, review all User Content, and We accept no liability whatsoever for it. We reserve the right — though not the obligation — to delete, remove, or edit any User Content which, in Our sole judgement, (a) breaches these Terms, (b) infringes intellectual property rights, or (c) is abusive, defamatory, obscene, or otherwise inappropriate.
10. Policy on Points-Based Incentive Programmes
If You complete a Survey, participate in another Research Programme, or make use of another Service, You may earn points, which can later be redeemed for various rewards or for cash through Our incentive scheme. No purchase is necessary to earn points. Points awarded are personal to You and may not be transferred to any other person. Points remain valid and redeemable for a period of twenty-four (24) months following the date Your account becomes inactive. Any points or rewards not redeemed by that time may be revoked by Us.At the start of each Survey, Research Programme, or other Service, You will be informed of the number of points You may earn. We do not accept any liability or responsibility for tax consequences or duties that may arise from the issuance or redemption of points or incentives. If You breach these Terms, You may forfeit any points or incentives You have accumulated. We accept no liability to You in relation to any forfeited points or incentives.
11. Profile Updates
Panel Members agree to keep their membership profiles up to date. A Panel Member may update, correct, and/or delete information contained in their membership profile by: (a) accessing their Panel membership account; or (b) sending an e-mail to the appropriate Panel Member services team for the relevant Panel.12. Opt-Out Policy
Panel Members may opt out of using any or all Services (including, without limitation, receiving Survey invitations, newsletters, or communications) at any time by: (a) following the unsubscribe procedures outlined on the relevant Panel Site or related sites, or contained in an e-mail received from Us; or (b) sending an e-mail to Our Panel Member services team here.We shall make reasonable efforts, as required by law or regulation, to respond to each e-mail request within a reasonable period of time after receipt. Upon termination of Services, a Panel Member’s contact details will be removed from all communications or contact lists relating to the terminated Service(s). Please note that this process may take a few days to complete and, during that time, You may still receive messages from Us that were created or scheduled prior to Your opt-out.
13. Links
In connection with Your use of the Service, You may be able to access or connect to a Third Party Website. Please note that We do not endorse any Third Party Website or any products, services, and/or opportunities advertised or offered through, or in connection with, such Third Party Websites. You are advised to review all applicable policies and terms of use for such Third Party Websites carefully.14. Communications with Us
All communications (excluding Personal Data) and User Content submitted or transmitted by You to Us, whether via e-mail or otherwise, or collected by Us, shall be treated as non-confidential and non-proprietary information, unless You explicitly indicate otherwise either prior to or at the same time as You provide or permit Us to collect such communications and User Content. You agree that We may use any such communications and User Content at Our sole discretion.15. Privacy
When applying for Panel membership, using a Service, or otherwise communicating with Us or a Panel Owner, Personal Data relating to You may be processed. You expressly agree that Your participation in a Survey, other Research Programme, and use of the Service, as well as browsing Our site, a Survey Site, a Panel Site, or a Partner Site, is undertaken at Your own risk and responsibility. To the fullest extent permitted by law, We, Our Clients, Survey Owners, Panel Owners, Partners, or other third parties, along with Our and their respective directors, officers, employees, representatives, agents, third-party content providers, and licensors, make no warranties—express, implied, or statutory—including, but not limited to, warranties of merchantability, fitness for a particular purpose, or that participation in a Survey or use of the Service, Our site, a Survey Site, a Panel Site, or a Partner Site will be uninterrupted or error-free. To the fullest extent permitted by law, no warranties are made as to the accuracy, reliability, or content of any information or services provided via a Survey, Our site, a Survey Site, a Panel Site, or a Partner Site, except where expressly stated in these Terms.17. Limitation of Liability
TO THE EXTENT PERMITTED BY APPLICABLE LAW, WE, SURVEY OWNERS, PANEL OWNERS, PARTNERS, THIRD PARTIES, OR OUR DIRECTORS, OFFICERS, SHAREHOLDERS, EMPLOYEES, REPRESENTATIVES, CONTRACTORS, SUCCESSORS, OR ASSIGNEES SHALL NOT BE LIABLE TO YOU IN ANY WAY, INCLUDING—BUT NOT LIMITED TO—ANY MATTER RELATING TO THESE TERMS, THE SERVICE, OUR SITE, A SURVEY, A PANEL SITE, A PARTNER SITE, OR ANY SUBMISSIONS YOU MAKE. THIS EXCLUSION OF LIABILITY COVERS DIRECT, INDIRECT, SPECIAL, PUNITIVE, INCIDENTAL, RELIANCE, EXEMPLARY, OR CONSEQUENTIAL DAMAGES, LOSS OF PROFITS, LOSS OF ANTICIPATED SAVINGS, OR ANY OTHER NON-DIRECT LOSSES, WHETHER OR NOT WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.The limitations and disclaimers set out in these Terms shall apply regardless of the basis of the claim—be it in contract, warranty, delict, quasi-delict, strict liability, negligence, or other tort. They shall remain in force even in the event of a fundamental breach or failure of the essential purpose of a contract, or the failure of an exclusive remedy.
18. Indemnification
You agree to fully indemnify, defend, and hold harmless Us, Survey Owners, Panel Owners, Partners, and other related third parties—including directors, officers, shareholders, employees, representatives, contractors, affiliates, successors, or assignees—against any and all damages, losses, liabilities, and expenses (including legal fees) arising directly or indirectly from Your breach of these Terms.19. Changes
We reserve the right, at Our sole discretion, to amend these Terms at any time. We encourage You to review the Terms regularly. Where required, We shall obtain Your consent prior to making changes. For amendments that do not require consent, Your continued access to, use of, or participation in the Services shall be deemed to constitute Your acceptance of the revised Terms.20. Compliance with Applicable Law
You acknowledge and agree that You shall at all times comply with all Applicable Laws when responding to a Survey, participating in another Research Programme, or otherwise using the Service.21. Suspension, Termination and De-Activation
In addition to any other available remedies, We may, without notice, suspend and/or terminate Your access to the Service or Your Panel membership if You breach these Terms, use the Service unlawfully, or otherwise behave in a way that, in Our sole discretion, is deemed unacceptable by Us, a Survey Owner, a Panel Owner, or a Partner. If Your right to use the Service or Your Panel membership is terminated: (a) You shall forfeit all rights, title, and interest in any unredeemed rewards, incentives, and/or prizes, effective immediately upon termination; (b) Your Panel membership shall be cancelled forthwith; (c) Your access to and use of the Service shall cease immediately; and (d) You shall not be permitted to take part in any future Surveys offered via the Service.We also reserve the right to de-activate Your Panel membership account: (a) if You are no longer considered an Active Panellist; (b) if Our email communications to You result in hard bounces or delivery failures; or (c) if We receive three (3) consecutive “mailbox full” replies from Your email address.
In the event of deactivation, or termination either by You or by Us, You shall forfeit any incentives You have accrued.
22. Severability and Assignment
If any provision of these Terms is found to be invalid or unenforceable for any reason, that provision shall be deemed severable from the rest of the Terms, and the remaining provisions shall remain in full force and effect.You may not assign or transfer these Terms without Our prior written consent, which may be withheld at Our sole discretion. You acknowledge and agree that We may assign these Terms at any time, to any party, without notice.
23. Governing Law, Jurisdiction and Legal Venue
Any disputes arising from or in connection with these Terms, including any matters relating to their existence, validity, or termination, shall be governed by and construed in accordance with the laws of Sweden, without regard to any conflict of law principles (whether Swedish or those of another jurisdiction). Any such disputes shall be referred to the Stockholm District Court (Sw. Stockholms tingsrätt) as the exclusive legal venue.
